Defective delivery / parcel damage: the seller is liable for loss and damage until delivery (Reg. art. 17/1; consistent with art. 11 of our manufacturing contract, which keeps transit risk with Stancona). On damaged delivery the buyer (1) sends a photo and (2) chooses a free re-make or full refund with all freight costs borne by the seller. Claims against the carrier are handled by the seller — the buyer never has to deal with the carrier.
2. Right of withdrawal (summary — the agreement binds)
- Period: 14 days from delivery, no reason, no penalty (Reg. art. 9).
- Notice: e-mail [email protected] or the on-site withdrawal form — a form is not mandatory; the SAMPLE form is provided in Annex 1 of the agreement. Receipt is confirmed immediately.
- Refund: within 14 days of the notice/goods reaching the seller, via the same payment instrument, including delivery costs, in a single payment and free of charge (art. 12/1,4).
- Return freight: borne by the seller. No clause shifting return freight to the consumer exists (art. 12/5 as amended effective 01.01.2026 — the Brief 3 source conflict resolves in the consumer's favour; counsel to give final confirmation anyway).
- Returning the goods: within 14 days of the withdrawal notice (art. 13/1).
- Exceptions: Reg. art. 15/1 — notably (ğ) intangible goods delivered instantly (digital products): no withdrawal right, nothing is accepted back. Full text in the agreement (arts. 6–7).
3. Return process (step by step)
- Notice — within 14 days via e-mail or the on-site form (no reason required).
- Confirmation — the seller confirms receipt immediately and sends return instructions.
- Shipping — the buyer ships within 14 days with packaging/labels intact, via the seller's designated return carrier (freight paid by the seller).
- Inspection — goods must be tested-but-undamaged with packaging/labels intact unless transit damage/shortage applies; hygiene-excepted items (opened packaging, unhygienic to return) are exempt from this rule — per-product list [Open Q-2: same SKU list as Brief 1 Open Q-1].
- Refund — if inspection passes, the refund follows step 2 within 14 days. A justified rejection is explained and return freight is stated.
Damaged/wrong item (not a withdrawal case): defective-goods rules (TKHY art. 11) apply — free repair/re-make, refund or proportional price reduction; all freight on the seller. Photo evidence + a 48-hour notice is recommended (operational recommendation; statutory periods — 14-day withdrawal and selection rights — are unchanged).
4. Non-parcel scenarios
- Pre-shipment cancellation: cancellations accepted before handover are refunded within 14 days.
- Out of stock / impossibility: notified within 3 days, all amounts refunded within 14 days (Reg. art. 16/4).
